Liability For Queens Pedestrian Accidents
A large portion of the pedestrian accidents in New York City occur in close proximity to the victim’s home. According to the New York City Department of Health, “More than half (57%) of older adult pedestrian fatalities and nearly three- quarters (72%) of child pedestrian fatalities died from a crash that occurred within 10 blocks of home compared with 35% among adults aged 18 to 64 years.” Cities can take a number of measures in order to prevent pedestrian accidents.
- Cities should ensure that all intersections are well illuminated.
- Cities should study which roads and intersections have the most collisions.
- Cities should install traffic-calming measures along roads with a history of speeding.
All drivers must remain vigilant and continuously scan the road ahead of them for potential hazards. Drivers should slow down in areas with heavy pedestrian traffic. If a driver fails to slow down in order to avoid hitting a pedestrian, they could be held liable through a civil claim. Many different factors could contribute to a pedestrian collision.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
Pedestrian accidents are usually preventable. Many drivers are simply not paying attention to the road ahead of them. They may be texting or distracted by some other device. Any person injured due to the negligent actions of a driver may be able to seek some measure of justice through a civil claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
