Liability In New Rochelle Hit-And-Run Accidents

Pedestrians are uniquely vulnerable in car accidents. They have a small profile and are more likely to be overlooked in collisions. They also lack the protection of enclosed vehicles. According to the Centers for Disease Control, “an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” Elderly pedestrians and young children are typically at the greatest risk for being involve in car accidents. There are many factors that could potentially contribute to a pedestrian accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver intoxication

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. When a driver is involved in an accident, they must remain at the scene and report the accident to police. Fleeing the scene of a car accident can result in criminal charges. Victims may also be able to seek aid through a negligence claim. Car accidents tend to leave victims with very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured in a pedestrian accident may be able to seek aid through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. It is extremely important to seek legal guidance after an accident. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
