Liability In Brooklyn Car Accidents
Thousands of pedestrians are killed or seriously injured every year in the United States. This year, 2021, has proven to be far more deadly for pedestrians across NYC. According to one report by the New York Post, “Pedestrian deaths in the city have surged 58 percent so far this year compared to the same period in 2020 — to 41 deaths from 26 — despite Mayor de Blasio’s “Vision Zero” program to make city streets less dangerous for walkers.” There are a number of factors that could potentially contribute to a pedestrian collision including:
- Distracted driving
- Inclement weather
- Drug use
All drivers have a legal responsibility to exercise due care in order to avoid hitting pedestrians. They must also reduce their speed limit to what would be safe given the prevailing conditions of the roadway. When a driver fails to exercise due care and strikes a pedestrian, they could be held at fault through a negligence claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A New York City pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
