Liability For New York City Pedestrian Accidents
Hit-and-run collisions remain all too common across New York and the United States. According to the AAA Foundation for Traffic Safety, “The current analysis found that both the rates of hit-and-run crashes and fatalities are increasing. There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds.” There are a number of measures that city officials can take in order to prevent collisions.
- The police should heavily enforce traffic infractions likely to lead to collisions.
- City officials should install traffic-calming measures in areas with a high rate of speeding.
- City officials can install pedestrian bridges and other measures to separate pedestrians from vehicles.
All drivers have a legal obligation to take reasonable steps in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any pedestrian collision.
- Fragments of any fleeing vehicle should be sought.
- Surveillance footage should be collected.
- A thorough investigation should be conducted.
- An experienced pedestrian accident attorney should be contacted.
The vast majority of pedestrian accidents are preventable. They tend to involve drivers who are speeding. In fact, nearly a third of fatal pedestrian accidents involve drivers operating their vehicles under the influence of alcohol or drugs. It is important that accident victims understand that they do have rights. The family of any person who died in a pedestrian collision may be able to seek some measure of justice through a civil claim.
