Liability for Flushing, Queens MTA Bus Accidents

Thousands of people are killed or seriously injured in bus accidents each year. According to the Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” Bus drivers should take several actions to avoid causing accidents.

  • Bus drivers should continuously scan the road ahead of them to avoid hazards.
  • Bus drivers should check their blind spot when making turns at an intersection.
  • Bus drivers should be well rested before heading out onto the road.

Buses are considered common carriers. Their drivers must exercise a great deal of caution to avoid colliding with other vehicles. This necessitates that bus drivers maintain a safe follow distance with the vehicle ahead of them. If a bus driver does not maintain a safe follow distance and collides with the rear of another vehicle, this could be considered negligence. Victims of bus accidents tend to suffer very serious injuries.

  • Broken bones
  • Lacerations
  • Head trauma
  • Organ damage

When a bus driver is negligent and causes a collision, their employer could be held at fault. In New York, employers could be held vicariously liable for wrongful actions of their workers who were operating within the course and scope of their job duties. Any person injured in a bus accident may be able to seek damages through a personal injury claim.
