Liability for New York Motorcycle Accidents
Motorcyclists are more likely to be overlooked by other drivers. They also lack the protection of enclosed vehicles. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022. A factor that directly influences motorcycle fatality trends is helmet use.” Drivers should take a number of measures in order to avoid hitting motorcyclists.
- Drivers should check their blind spots in order to avoid collisions.
- Drivers should use their turn signals to let other drivers know about their intentions.
- Drivers should maintain a safe speed at all times.
All drivers must take steps in order to avoid collisions. Many collisions are due to drivers that make unsafe lane changes in the roadway. Pursuant to New York VTL § 1128, a driver may not change their lane unless they have first ascertained that it is safe to do so. If a driver turns into the path of a motorcyclist or other vehicle prior to a collision, this could form the basis of a negligence claim. It is important that evidence is properly collected after any collision.
- Surveillance footage should be sought.
- Medical records should be collected.
- The police report related to the collision should be reviewed.
It can be difficult to know where to begin after any collision. This is especially true when a family loses someone in a fatal crash. It is important that victims of car accidents understand that they do have rights. In particular, the family of any person who died in a collision may be able to seek some measure of justice through a civil claim.
