Liability for Sanford Dump Truck Accidents
Dump trucks can be particularly dangerous for pedestrians and other people on the roadway. According to the Engineering News Record, “Serious accidents involving dump trucks and ready-mix concrete delivery trucks continue to edge up, part of a persistent, multi-industry problem with poor driving habits that has not yet responded to increased fleet and vehicle insurance premiums.” Dump truck companies should take several measures in order to avoid collisions.
- Dump truck drivers should be given routes that avoid left turns.
- Dump truck companies should ensure that all of their drivers are well trained.
- Dump truck drivers should not haul loads that exceed maximum carrying capacities.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Dump truck drivers will typically need to acquire a commercial driver’s license and are held to a particularly high standard. If a dump truck driver failed to slow down in order to avoid a collision, this could form the basis of a negligence claim. Victims of dump truck collisions tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The vast majority of dump collisions are preventable and involve one or more safety violations. This could include instances where drivers are fatigued or intoxicated. In fact, the Centers for Disease Control estimated that staying awake for only 18 hours can reduce a person’s ability to drive safely equal driving with a BAC of 0.05%. Any person injured in a dump truck collision may have legal recourse through a civil claim.
