Liability In Queens Storm Drain Falls
Falls remain one of the most common causes of injury and death in the United States. Construction workers and elderly pedestrians remain at the greatest risk of being involved in and seriously injured from a fall. According to the Centers for Disease Control, over 800,000 people are hospitalized from a fall injury every year. Falls continue to remain one of the leading causes of traumatic brain injuries (TBI). There are many different ways that a fall could occur including:
- Ladder falls
- Scaffold falls
- Sidewalk falls due to uneven pavement
- Stair falls
- Roof falls
New York City has a legal responsibility to maintain public property and roads in a reasonably safe condition. This needs to be done for the protection of all persons on a property whose presence is reasonably foreseeable. When a property owner is aware of a dangerous condition on their property and they fail to take action they could be liable in the event of an accident. There are numerous ways that a public area could be in a dangerous condition.
- Storm drains should be properly covered by grates. These grates should be strong enough to be walked over. But this doesn’t always happen.
- When a storm drain is being worked on there should be warning signs around the storm drain. Yellow tape or physical barriers can let people know there is an open storm drain.
- A storm drain or the grate the covers it could be structurally unsound. This might lead to it collapsing and someone falling through.
It is crucial that evidence is properly preserved and protected after an accident. For example, why was any storm drain left uncovered? Have there been similar incidents at the location of any accident? Work records should be examined. Collecting medical records and bills is also very important. Victims of fall accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Organ damage
- Spinal cord injuries
When a person is injured after falling down a storm drain they may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. In order to win a claim against the city victims will have to demonstrate negligence. But city officials and their lawyers will fight hard to try to deny responsibility for any accident. A Queens premises liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
