Liability for Bohemia Semi-Truck Accidents
Truck drivers are required to obtain a commercial license. They must be particularly cautious when backing up or making turns at any intersection. Pursuant to NY Veh & Traf L § 1211, “The driver of a vehicle shall not back the same unless such movement can be made with safety and without interfering with other traffic.” It can be particularly dangerous for a truck driver to back up in a variety of different situations.
- Truck drivers should avoid backing up at night and during periods of reduced visibility.
- Truck drivers should avoid blocking multiple lanes of traffic as they are backing up.
- Truck drivers should avoid backing up during periods of very poor weather.
If a truck driver makes a dangerous turn into the path of another vehicle, this could serve as evidence of negligence. The company that the truck driver worked for could also be held at fault. Generally, speaking, truck companies can be vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties. Any person injured in a truck accident may be able to pursue some measure of accountability for a personal injury claim.
