Liability for New York City Semi-Truck Accidents
Car accidents remain a leading cause of death and injury in New York. Pedestrians are particularly vulnerable. According to the New York Department of Health, “Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually. It is important for both drivers and pedestrians to pay attention and follow the law to prevent injuries.” Trucks can be particularly dangerous for many reasons.
- Trucks have large blind spots that may obscure the presence of pedestrians.
- Trucks can weigh 80,000 lbs and have much longer stopping distances than other vehicles.
- Trucks have a wide turning radius and are more likely to be involved in side-impact collisions.
All drivers must take reasonable measures to avoid colliding with pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a dump truck driver fails to take reasonable steps to avoid colliding with a pedestrian, their employer could be held at fault through a civil claim. There are many potential errors a truck driver may have made when hitting a pedestrian.
- The truck driver may have been speeding.
- The truck driver may have been distracted by their phone.
- The truck driver may have failed to check their blind spots.
It has been estimated that 93% of all collisions involve some amount of human error. Sadly, though, truck drivers and their employers will often do everything in their power to deny liability if they kill a pedestrian. They may try to blame the victim or other third parties. This is why it is so essential that all fatal pedestrian accidents are properly investigated by an independent party. The family of any person who died in a pedestrian collision may be able to seek some measure of accountability through a civil claim.
