Liability In Halfmoon Car Accidents

Thousands of pedestrians are killed or seriously injured in car accidents every year. According to one report from the Centers for Disease Control, “an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers must operate their vehicle according to the prevailing conditions of the roadway.
  • Drivers should check their blind spots before making turns.

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians in the roadway. According to New York Vehicle & Traffic Law § 1146(a), every driver must exercise due care in order to avoid hitting pedestrians and bicyclists. A large number of collisions are due to drivers that are speeding and fail to see pedestrians in the roadway. When a driver fails to exercise due care and hits a pedestrian, they can be held accountable through a civil claim. There are many steps that should be taken after a pedestrian collision.

  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • The vehicles involved should be examined.

The family of any pedestrian that is killed in a car accident may be able to seek justice through a wrongful death claim. Damages can help cover lost wages, medical bills and funeral expenses. Sadly, though, insurance companies will often fight hard to deny liability for any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
