Liability for School Bus Collisions
Car accidents remain one of the leading causes of injury for children in the United States. According to IIHS, “Seventy percent of child motor vehicle crash deaths in 2022 were passenger vehicle occupants, 16% were pedestrians, and 3% were bicyclists. Child pedestrian and bicyclist deaths declined by 91% and 93%, respectively, since 1975. Passenger vehicle child occupant deaths in 2022 were 56% lower than in 1975.” School bus drivers should take a number of measures in order to avoid collisions.
- School bus drivers should check their blind spots before making turns.
- School bus drivers should slow down during adverse weather conditions.
- School bus drivers should abstain from alcohol and other intoxicating substances.
School buses are considered common carriers. Their drivers are held to a high standard in terms of safety. All school bus drivers must operate their vehicle within a single lane of traffic and only move when it is safe to do so. There is a rebuttable presumption of negligence on the part of any driver that leaves the roadway and collides with a fixed object. It is important that certain steps are taken after any school bus collision.
- Surveillance footage should be sought.
- Medical records related to the incident should be preserved.
- The accident report for the collision should be collected.
- An experienced bus accident attorney should be contacted.
If a school bus driver was working at the time of a collision, their employer could potentially be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person injured in a school bus accident may be able to seek some measures through a civil claim.
