Liability for New Jersey Dump Truck Accidents
Dump trucks can be incredibly dangerous given their enormous size and weight. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” There are a number of factors that can contribute to a dump truck collision.
- Truck accidents are more likely if one or more drivers are speeding.
- Truck accidents are more likely during periods of reduced visibility.
- Truck accidents are more likely if drivers are fatigued.
All truck drivers have a legal obligation to take reasonable measures in order to avoid causing accidents. They must continuously scan the road ahead of them and slow down in order to avoid hazards. If a dump truck driver fails to take evasive action to avoid a collision, this could form the basis of a negligence claim. Victims of dump truck accidents tend to suffer very serious injuries.
- Broken bones
- Lacerations
- Organ damage
- Death
Depending on the facts of any case, a car company like Tesla could potentially be liable for a collision. All modern Teslas have semi-autonomous driving features. These features have been known to malfunction from time to time and seriously jeopardize or injure drivers. This has included instances where a Tesla fails to slow down for a hazard or jerks violently into opposing lanes of traffic. The family of any person who died in a Tesla crash may have legal recourse through a civil claim.
