Liposuction is a popular type of cosmetic surgery that removes unwanted deposits of excess fat. Although cosmetic surgeons routinely perform this procedure, liposuction can have serious ramifications, especially for candidates who have serious medical problems.

Pineda, who had undergone heart transplant surgery in 2004, was not the ideal candidate for a liposuction procedure. Regardless of this important fact, Davie agreed to perform the surgery on May 10, 2012. Shortly after the surgery, Pineda went into cardiac arrest and died in Davie’s office.
Davie’s medical records eradicated all references to Ms. Pineda’s heart transplant and the anti-rejection medications. However, Davie’s scheme backfired when an original version of the form was later found in Pineda’s handbag, clearly depicting her 2004 heart transplant and the list of medications she was taking.
Davie’s medical license was previously restricted by the State during the time that he was treating Ms. Pineda.
In addition to the civil lawsuit, Davie is also under criminal indictment for murder. He pleaded not guilty to manslaughter and criminally negligent homicide charges for operating on Pineda.
