Liability for Manhattan Apartment Fires
Many people are killed or seriously injured in residential fires across NYC every year. Many of these accidents are caused by portable heaters. According to the NYC Comptroller, “Between 2017 and 2021, there were over 100 fires in New York City residential buildings caused by portable heaters like the one that caused the Twin Parks fire. Over that same period, New Yorkers called 311 nearly one million times to report a lack of heat in their homes.” There are several other common causes of apartment fires.
- Cooking accidents
- Lithium-ion battery explosions
- Unattended candles
- Electrical short circuits
Depending on the facts of any case, the owner of an apartment could potentially be liable for any residential fire. Property owners in New York City have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for all persons who visit property whose presence is reasonably foreseeable. When a property owner has actual or constructive notice of a dangerous condition with their property, they must take action. There are a number of ways that an apartment owner may have acted negligently and contributed to a fire.
- An apartment owner may have failed to install smoke detectors.
- An apartment owner may have allowed building exits to become obstructed.
- An apartment owner may fail to perform routine maintenance on appliances.
The vast majority of residential fires are preventable. These types of situations often involve safety regulations not being followed. Even if the cause of the fire did not involve some amount of negligence, this does not necessarily absolve the apartment owner. There may have still been some amount of fault in the systems designed to warn residents of the fire. The family of any person killed in a fire may be able to seek some measure of accountability through a civil claim.
