Liability For Manhattan Subway Train Accidents
Accidents involving subways and trains remain all too common. According to the National Safety Council, “Railroad deaths totaled 995 in 2023, a 10% increase from the 2022 revised total of 908 and the highest since 2007. Nonfatal injuries totaled 6,705, a 3% increase from the 2022 revised total of 6,513.” Public transit companies should take a number of measures in order to prevent collisions.
- Public transit companies should periodically inspect and maintain railroad tracks and subway stations.
- Subway conductors should be well trained.
- Subway trains should be equipped with obstacle detection and surveillance systems.
- Subway trains should be equipped with fail-safe braking systems.
Mass transit companies have a legal obligation to exercise a great deal of caution in order to avoid causing accidents. In particular, subway conductors must constantly scan the tracks ahead of them. If a subway operator fails to slow down in time to avoid hitting a pedestrian on the tracks, this could form the basis of a negligence claim. Victims of subway accidents tend to suffer very serious injuries.
- Broken bones
- Amputations
- Lacerations
- Head injuries
Subway accidents are often highly preventable. Sadly, though, subway companies will often do everything in their power to deny responsibility if they injure someone. They will blame the victim or say that it was someone else’s fault. This is why it is so important for victims of subway accidents to seek legal advice as early as possible. A subway accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
