Thomas Dunlea Killed In Manhattan Car Accident On The West Side Highway

MANHATTAN, NEW YORK (January 12, 2022) – A man identified as Thomas Dunlea has tragically died nearly two weeks after being involved in a car accident on the West Side Highway.

New York City police officials are saying that the collision took place on Sunday, December 29th. Thomas Dunlea was driving in his Hyundai SUV when he was hit by a black Mercedes-Benz sedan.

Paramedics were called to the scene of the collision in order to help the victim. He was found unconscious in the roadway with a head injury.

Thomas Dunlea was taken to the Weill Cornell Medical Center in order to receive treatment. Despite life-saving measures, he died nearly two weeks after being admitted.

At least 18 people have died at the same intersection since 2011.

Liability In Manhattan Car Accidents

Thousands of people are killed or seriously injured every year in car accidents. According to one report by the Insurance Institute for Highway Safety (IIHS), “There were 33,244 fatal motor vehicle crashes in the United States in 2019 in which 36,096 deaths occurred. This resulted in 11.0 deaths per 100,000 people and 1.11 deaths per 100 million miles traveled.” The vast majority of collisions are preventable and due to human error. There are a number of factors that could potentially contribute to a car accident including:

  • Speeding
  • Inclement weather
  • Driver distraction
  • Driver fatigue
  • Drug use

All drivers have a legal obligation to exercise due care in order to avoid hitting other vehicles. Many collisions are due to drivers that are speeding. According to New York Vehicle & Traffic Law 1180, no person shall operate a motor vehicle at a speed greater than what would be reasonable and safe given the prevailing conditions and traffic of the roadway. A city could also potentially be liable for a collision.

Cities in New York have a legal obligation to maintain their roadways in a reasonably safe condition. When there is a history of collisions at a particular intersection this could be indicative of a dangerous condition with the roadway. For example, a road could lack adequate signs or traffic signals. Victims of car accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Spinal cord injuries
  • Lacerations

The family of any victim that died in a car accident may be able to seek aid through a wrongful death claim. Damages can help cover some of the unexpected expenses that often come with the sudden loss of a love one. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
