Liability for Brooklyn Pedestrian Accidents
Thousands of people are killed or seriously injured in truck accidents every year in the United States. According to the National Security Council, “In 2022, 5,837 large trucks were involved in a fatal crash, an 1.8% increase from 2021 and a 49% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is up 3% from 2021, and up 24% in the last 10 years. ” A number of different factors could contribute to a truck accident.
- Many truck accidents are due to truck drivers that are speeding, especially in urban areas.
- Truck accidents often involve drivers making left turns.
- Fatigue can substantially increase the odds that a truck driver fails to slow down to avoid hitting a pedestrian.
Truck drivers have a legal obligation to take steps to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid a collision with a bicyclist, they could be held liable through a civil claim. Victims of pedestrian accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Truck accidents are often highly preventable. In many situations, truck companies will push their drivers to complete delivery schedules that lead to them being dangerously fatigued. For perspective, staying awake only 18 hours reduces a person’s ability to drive safely equal to driving with a blood alcohol concentration of 0.05%. The family of any pedestrian who died in a truck accident may have legal recourse through a wrongful death claim.
