Liability for Long Island Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured in car accidents every year. According to the Centers for Disease Control, “Over 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2022. That’s about one death every 64 minutes. There were also an estimated 140,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2022.” Drivers should take several actions to avoid pedestrian accidents.
- Drivers should slow down when pedestrians are close by.
- Drivers should check their blind spots before making turns.
- Drivers should abstain from alcohol and other intoxicating substances.
Drivers have a legal obligation to slow down to avoid colliding with any pedestrian in the roadway. They must be particularly cautious around children and any person who appears to be confused. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of car accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Depending on the facts of any case, there could be numerous liable parties for any pedestrian accident. In particular, the company that owned or operated a truck could be legally responsible for an accident. Companies in New York can be held vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties. The family of any person who died in a truck accident may be able to seek some measure of justice through a wrongful death claim.
