Liability for Brooklyn Pedestrian Accidents
Car accidents remain one of the leading sources of serious injury and death for pedestrians across New York City and the United States. According to the IIHS, “A total of 7,314 pedestrian deaths occurred in 2023. Pedestrian fatalities account for 18% of all crash fatalities. Pedestrian deaths in 2023 have increased 78% since reaching their lowest point in 2009.” Drivers should take a number of measures to avoid colliding with pedestrians.
- Drivers should check their blind spots before making turns at intersections.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should continuously scan the road ahead of them for pedestrians and other hazards.
Drivers must use caution to avoid colliding with any person in the roadway. This necessitates that they maintain their vehicle at a safe speed at all times. If a driver fails to slow down to avoid colliding with a pedestrian in the roadway, this could be construed as negligence. It is important that evidence be properly preserved after any pedestrian accident.
- The police should be called to the scene as early as possible so that they can create an official report.
- Medical records related to the accident should be collected and preserved.
- Surveillance footage that may have captured the accident should be sought.
Depending on the facts of any case, there could be numerous liable parties for any pedestrian accident. For example, a commercial vehicle may have hit a pedestrian. If a vehicle was being used for business purposes at the time of a crash, the company that owned or operated that vehicle could be held vicariously liable. Companies are liable for accidents involving their workers who were operating within the scope and course of their job duties.
