But doctors were not able to save him, and he was pronounced dead at the hospital. A full investigation remains ongoing at this time.
Liability For Brooklyn Pedestrian Accidents
Car accidents remain a leading cause of preventable injury for people across New York. According to the New York State Department of Health, “Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually. It is important for both drivers and pedestrians to pay attention and follow the law to prevent injuries.” There are a number of steps that city officials can take to prevent pedestrian collisions.
- City officials can install traffic calming measures along roads and intersections with a history of speeding.
- Cities should install pedestrian bridges in certain locations.
- Cities should ensure that intersections are well illuminated so that drivers can see pedestrians.
All drivers have a legal obligation to take steps in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When a driver fails to slow down in order to avoid hitting pedestrians, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Pedestrian accidents are often highly preventable. They tend to involve drivers who are speeding or distracted. A disproportionate number of collisions involve drivers making left turns. It is vital that pedestrians understand that they do have rights. In particular, the family of any pedestrian who died in a box truck accident may have legal recourse through a wrongful death claim.
