Liability for Evesham Township School Bus Accidents
School buses are typically very safe for passengers. But they can pose significant hazards for those in smaller vehicles. According to the National Safety Council, “School bus-related crashes killed 128 people nationwide in 2023, up 23% compared to the 104 deaths in 2022, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” There are many reasons that school buses can be dangerous.
- School buses have large blind spots that can obscure the presence of smaller vehicles.
- School buses can weigh tens of thousands of pounds and be deadly even at lower speeds.
- School buses are inherently top-heavy and can easily roll over during sharp turns.
School buses are considered common carriers. Their drivers must operate with an abundance of caution to avoid collisions. Bus drivers must maintain a safe distance from all vehicles ahead of them. If a bus driver fails to slow down and collides with another vehicle, this could form the basis of a negligence claim. It is important that certain actions are taken after any school bus accident.
- Victims should seek a thorough medical evaluation.
- Victims should call the police and report the accident.
- Victims should avoid speaking with the other party’s insurance provider.
- Victims should seek the guidance of an experienced school bus accident attorney.
If a school bus accident results in serious injuries, victims may be able to pursue damages through a civil claim against the owner of the school bus. Employers in New Jersey can be held vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
