Liability for Town of Clay Workplace Accidents
Many workers are killed or seriously injured every year in construction accidents. According to the U.S. Bureau of Labor Statistics, “In 2023, about 1 in 5 (20.8 percent) workplace deaths occurred in the construction industry and 38.5 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for 47.8 percent of all fatal falls, slips, and trips in 2023.” There are many different causes of construction accidents.
- Construction accidents may occur due to inadequate communication between people at a construction site.
- Speeding is another major problem. A number of workers are killed by speeding vehicles at construction sites.
- Construction accidents are also more common when OSHA regulations are being violated.
Construction companies and general contractors could be liable for accidents through New York Labor § 200. According to the statute, “All places to which this chapter applies shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” When a workplace is in an unsafe condition, this could form the basis of a civil claim. Certain steps should be taken after any construction accident.
- Eyewitnesses should be interviewed.
- Medical records related to the accident should be preserved.
- Surveillance footage should be sought.
- An experienced civil rights attorney should be contacted.
Most construction accidents are entirely preventable. They tend to involve situations where safety regulations are not being followed. It is important that workers and their surviving family members understand that they do have rights. They are able to seek some measure of accountability through a civil claim. A construction accident attorney can examine the unique facts of your case and let you know what your legal options are.
