Liability for New York City Pedestrian Accidents
Pedestrians lack the protection of enclosed vehicles and are therefore uniquely vulnerable to the hazards of car accidents. According to the National Safety Council, “According to NHTSA data, in 2022 most pedestrian traffic deaths occurred in urban settings (84%), on the open road (76%) versus intersections (24%), and during dark conditions with or without artificial lighting (74%).” There are many factors that could contribute to a pedestrian accident.
- Pedestrian accidents are much more likely to occur when drivers are speeding.
- Pedestrian accidents often involve a driver that is intoxicated.
- Pedestrian accidents may involve drivers that are distracted.
All drivers have a legal obligation to exercise care in order to avoid colliding with any pedestrian in the roadway. This may require that they slow down substantially, depending on the prevailing conditions of the roadway. If a driver fails to slow down to avoid a pedestrian crossing the road, this could form the basis of a negligence claim. It is essential that several measures are taken after any pedestrian accident.
- Surveillance footage that may have captured the accident should be sought.
- Eyewitnesses should be interviewed.
- A police report of the incident should be created.
Pedestrian accidents are often highly preventable. It has been estimated that nearly 93% of all car accidents involve human error. Sadly, though, drivers will often do everything in their power to try to avoid responsibility if they are involved in a collision. The family of any person who is killed in a pedestrian accident may be able to seek some measure of accountability through a civil claim.
