Liability for Genesee County Tour Bus Accidents

Bus companies are considered common carriers. Their drivers must operate with an abundance of caution to avoid causing accidents. Many bus accidents are due to bus drivers that make dangerous lane changes. Pursuant to NY Veh & Traf L § 1128, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” There are numerous sources of negligence that may have contributed to a bus accident.

  • Speeding: A bus driver may have been traveling too fast for the prevailing conditions before losing control.
  • Distracted Driving: A bus driver may have been distracted by their phone or some other object.
  • Vehicle System Failures: The component parts on a bus may have malfunctioned and caused a crash. In particular, many bus accidents are caused by tire blowouts.

If a bus driver’s negligence contributed to a bus accident in some way, their employer could be held at fault for the crash. Generally speaking, companies are liable for the wrongful actions of their employees–insofar as those employees were working within the course and scope of their job duties. This will include instances where a bus is being used to transport paying customers.

Steps to Take After a Bus Accident

Bus accidents are quite common and leave victims with serious injuries. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” Victims of bus accidents should take a number of steps to preserve their legal rights, health, and financial well-being.

  • Medical Evaluation: Victims should seek a thorough medical evaluation, even if they think they’re alright after a crash. Many of the injuries associated with a bus accident may not be immediately obvious.
  • Document the Scene: Victims should document as much of the scene as they can. Take photos, videos, and gather phone numbers from eyewitnesses.
  • Contact an Attorney: Any person injured in a bus accident should seek the guidance of an experienced New York bus accident attorney. An attorney can take steps to ensure your rights are protected and that you are fairly compensated for your injuries.

There are a number of laws designed to help victims of bus accidents. They are able to seek some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. The FMCSA requires buses that can carry 16 or more people to have at least $5 million in liability coverage. If you’ve been injured in a tour bus accident, the best thing that you can do is reach out to a lawyer as soon as possible.
