Liability for Borough Park Pedestrian Accidents
Many pedestrians are killed or seriously injured each year in accidents with passenger vehicles. According to the Governor’s Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” Drivers should take several measures to avoid hitting pedestrians.
- Drivers must continuously scan the road ahead of them for hazards.
- Drivers should check their blind spots before making turns in the roadway.
- Drivers should ensure their vehicles are routinely inspected and maintained.
Drivers must use caution to avoid colliding with any person in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, they could be legally responsible for their injuries. It is also possible that liability could extend to other parties. For example, if a van was being used for commercial purposes when it crashed, the company that owned the van could be held at fault. It is important that certain measures are taken after any pedestrian collision.
- Surveillance footage that may have captured the crash should be sought.
- Eyewitnesses should be interviewed.
- The police should be called to the scene so that they can investigate.
- Victims should contact an experienced pedestrian accident attorney.
Pedestrian accidents are usually preventable. They tend to involve situations where drivers are not paying adequate attention to the road ahead of them. This is particularly true when drivers are making left turns. Any person injured in a pedestrian accident may be able to seek some measure of accountability through a civil claim. This is also true for surviving family members. They are able to pursue damages through a wrongful death claim.
