Recalled Baby Powder Sold on Amazon and Distributed to 35 States Possibly Contaminated With Asbestos
MANHATTAN, NEW YORK (November 30, 2024) – Dynarex Baby Powder, created by Dynarex Corporation, has been recalled because it is possibly contaminated by asbestos.
Prior to the recall, parents could purchase the baby powder on Amazon and at stores across 35 states. The recall came after a routine sampling by the Food and Drug Administration.
Consumers who have purchased Dynarex Baby Powder are advised to immediately stop using it. No illnesses have been reported at this time.
Liability for Injuries Caused by Asbestos Exposure
Asbestos is a naturally occurring mineral and known carcinogen. According to the Environmental Protection Agency, “Exposure to asbestos increases your risk of developing lung disease. That risk is made worse by smoking. In general, the greater the exposure to asbestos, the greater the chance of developing harmful health effects. Disease symptoms may take many years to develop following exposure.” There are many ways that a baby powder could potentially become contaminated with asbestos.
- Talc and asbestos are both silicate minerals that form under similar conditions. If talc is mined where asbestos is present, this could create cross-contamination.
- When mining companies fail to properly test and segregate talc from asbestos-containing rock, contamination may take place.
- Manufacturers should routinely test for asbestos in talc products. Failure to test could easily result in contamination.
Companies that manufacture baby powder and other products have a legal obligation to ensure that those products are reasonably safe. They must comply with all safety regulations set by the Food and Drug Administration. If a company creates a product that is tainted with dangerous substances such as asbestos, this could form the basis of a product liability claim. It is important that certain steps are taken after asbestos exposure.
- Medical records should be preserved.
- The source of the asbestos should be determined.
- An experienced product liability attorney should be contacted.
It can be hard to know where to begin after developing an illness from exposure to asbestos. In many situations, victims may not even realize that they have been exposed to a dangerous substance for many months or years. It is important that victims of asbestos exposure understand that they do have legal options. They are able to seek some measure of accountability through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
