Liability for Beacon Construction Accident
The construction industry continues to be overrepresented in terms of serious accidents every year. According to the Bureau of Labor Statistics, “In 2023, about 1 in 5 (20.8 percent) workplace deaths occurred in the construction industry and 38.5 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for 47.8 percent of all fatal falls, slips, and trips in 2023.” Several different factors could contribute to construction accidents.
- Construction accidents are much more likely when there is not clear communication between workers.
- Construction accidents are more likely when workers are not provided with adequate safety equipment, including fall protection.
- Construction accidents tend to be the results of unsafe work environments.
Building owners and general contractors can be held strictly liable for construction accidents in New York. This is particularly true if a construction accident was gravity related. In other words, a worker may have fallen or been hit by a fallen object. It is important that certain actions are taken after any construction accident.
- A thorough investigation of the accident by OSHA should be conducted.
- The safety history of the construction site should be understood.
- Victims should seek thorough medical evaluation and let their doctors know that their injury was work-related.
It can be difficult to know where to begin after any construction accident. This is particularly true if a construction accident resulted in the death of a worker. Family members may lose their breadwinner and struggle to pay bills. In these situations, it is important that surviving family members understand that they do have legal options. They are able to seek some measure of accountability and justice through a civil action.
