Liability for New Jersey School Bus Accidents
Many people are injured in collisions with school buses every year. According to the National Safety Council, “From 2013 to 2022, about 71% of the deaths in school bus-related crashes were occupants of vehicles other than the school bus, and 16% were pedestrians. About 5% were school bus passengers, 4% were school bus drivers, and 3% were pedalcyclists.” There are a number of factors that may contribute to a school bus collision.
- School buses are naturally top-heavy and are more likely to be involved in rollovers.
- School buses can become unstable at higher speeds and around turns.
- School bus collisions are more likely to occur at night and during times of reduced visibility.
School bus drivers are considered common carriers. They must do everything in their power to avoid collisions and keep their passenger safe. This may necessitate that they travel well below the speed limit, depending on the prevailing conditions of the roadway. If a school bus driver fails to operate their vehicle safely and departs the roadway, this could form the basis of a negligence claim. Victims of school bus accidents often suffer very serious injuries.
- Bone fractures
- Contusions
- Soft tissue injuries
- Organ damage
Many of the injuries associated with school bus accidents are not immediately obvious. A car accident can cause people to have a surge of adrenaline. which masks injury severity. This is why it is so important that accident victims undergo a thorough medical evaluation. After a medical evaluation, it is also a good idea for victims to speak with an experienced attorney. An attorney can help identify all liable parties and help victims get the support that they are entitled to under the law.
