Liability for Midtown Manhattan Pedestrian Accidents
Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. According to the National Security Council, “in 2022 most pedestrian traffic deaths occurred in urban settings (84%), on the open road (76%) versus intersections (24%), and during dark conditions with or without artificial lighting (74%). The largest number of pedestrian deaths occur on Saturdays (1,278), closely followed by Fridays (1,121).” There are a number of factors that could contribute to an inmate death.
- Distracted driving
- Inclement weather
- Poor road conditions
- Driver intoxication
All drivers have a legal obligation to use caution in order to avoid causing collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver hits a pedestrian, they could be held at fault through a civil claim. Several steps should be taken after any pedestrian accident.
- Surveillance footage should be sought.
- Medical records should be preserved.
- The history of collisions at the intersection or road should be understood.
- An experienced personal injury attorney should be contacted.
Pedestrian accidents are often highly preventable. They tend to involve situations when drivers are distracted, speeding, or committing other traffic infractions. These accidents can be overwhelming for victims. It is important that they understand that they do have legal options if they are injured in a pedestrian crash. They are able to seek some measure of justice through a civil claim.
