Liability for New York City Bicycle Accidents
Far too many people are seriously injured or killed in bicycle collisions every year. According to the National Security Council, “The number of preventable deaths from bicycle transportation incidents increased 10% in 2022 and have increased 47% in the last 10 years (from 925 in 2013 to 1,360 in 2022). All drivers have a legal obligation to exercise due care in order to avoid causing accidents. If a driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. A police department could also potentially be held liable for a car accident during a police chase. If officers showed a reckless disregard for public safety. It is important that certain steps are taken after any fatal bicycle collision.
- Eyewitnesses should be interviewed.
- Medical records related to the accident should be sought.
- A thorough investigation should be conducted.
- An experienced bicycle accident attorney should be contacted.
Police chases are highly dangerous. They routinely cause fatal collisions with innocent bystanders. They should only be used as an absolute measure of last resort. But far too often this does not happen. It is important that bicyclists and their family members understand that they do have legal rights. They’re able to seek some measure of accountability through a wrongful death claim.
