Construction Worker KilledIn Bedford Stuyvesant, Brooklyn Car Accident

BROOKLYN, NEW YORK (October 30, 2024) – A construction worker has tragically died in a Bedford Stuyvesant, Brooklyn collision by Myrtle Avenue and Walworth Street.

New York City officials are saying that the collision took place around 2:00 p.m. on Tuesday. The construction worker was operating as a flagger when he was hit by a white Ford van allegedly speeding.

The Ford van tried to pass a box truck before veering into the construction zone and hitting a 37-year-old construction worker. Paramedics were called to the scene in order to help the victim.

Sadly, he later died due to his injuries. The driver of the van has been charged with negligent homicide and reckless driving.

A full investigation into the Bedford Stuyvesant collision remains ongoing at this time.

Liability For Brooklyn Car Accidents

Car accidents remain a major cause of workplace injury and death in the United States. According to the National Safety Council, “In 2022, 891 people were killed and 37,701 people were injured in work zone crashes. Work zone crashes are defined as taking place within the boundaries of a work zone or on an approach to or exit from a work zone due to activities, behaviors, or controls related to traffic moving through the boundaries of a work zone.” There are several ways that construction companies can protect their workers from car accidents.

  • Construction companies should set up clear, well-lit, and reflective signs.
  • Construction companies should use barrier systems to separate workers from lanes of traffic.
  • Construction companies should use spotters and flaggers.
  • Construction companies should provide their workers with high-visibility clothing.

All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to New York Vehicle & Traffic Law § 1180, no person is allowed to operate a motor vehicle faster than what would be prudent or safe given the prevailing conditions of the roadway. If a driver fails to slow down in order to avoid hitting a construction worker, this could be the basis of a civil claim. It is crucial that certain steps are taken after any car accident.

  • Surveillance footage should be sought.
  • Medical records related to injuries should be collected.
  • A police report should be created.
  • An experienced personal injury attorney should be contacted.

Depending on the facts of any case, liability for any collision could extend beyond any driver. A construction company could be liable for a collision if it was caused by an unsafe condition on their premises. It is important that accident victims understand that they do have rights. The family of any worker who died in a car accident may be able to seek some measure of accountability through a wrongful death claim.
