BROOKLYN, NEW YORK (July 12, 2025) – Two pedestrians have tragically died in a Sunset Park hit-and-run car accident at Third Avenue and 52nd Street.
New York City officials are saying that the accident took place on Friday. Two pedestrians, ages 80 and 59, were crossing the intersection when they were struck by a BMW driver that went past a steady red light.
Paramedics were called to the scene to help the victims. Sadly, both died due to the severe nature of their injuries.
Police have arrested the driver of the BMW on suspicion of criminally negligent homicide and leaving the scene of an accident that resulted in death. A full investigation remains ongoing.
Thousands of pedestrians are killed or seriously injured every year in collisions with negligent drivers. According to the National Safety Council, “While pedestrians accounted for about 17.9% of traffic deaths in 2023, this percentage varies by age. Pedestrians represent 20% or more of traffic deaths among 35- to 74-year-olds. The largest number of pedestrian deaths occurs among 35- to 44-year-olds (1,328).” Many factors could contribute to a pedestrian collision.
Speeding remains one of the main causes of pedestrian accidents in the United States. All drivers have a legal obligation to exercise caution to avoid colliding with any passenger in their way. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. When a driver flees the scene of an injury collision, they could also face criminal liability for their actions. It is important that certain steps are taken after any hit-and-run.
Pedestrian accidents are often highly preventable. These incidents tend to involve situations where drivers are violating traffic regulations. In particular, many drivers involved in fatal hit-and-run collisions are intoxicated. The family of any pedestrian killed in a collision may have legal recourse through a civil claim.
We at GLK Law extend our best wishes to the families of the pedestrians killed in this collision. Any person that may have more information about what happened should reach out to the NYPD. There needs to be a thorough investigation into what went wrong.
