Liability for Brooklyn Apartment Fires

New York City is one of the most dense urban areas in the world. Many people are seriously injured or killed in residential fires every year across the city. Many of these were caused by portable heaters. According to the NYC Comptroller, “Between 2017 and 2021, there were over 100 fires in New York City residential buildings caused by portable heaters like the one that caused the Twin Parks fire.” There are many other potential causes of apartment fires.

  • A number of fires have been caused by malfunctioning lithium-ion batteries.
  • Many fires are the result of unattended cooking.
  • Fires could be started because key appliances are not being properly maintained.

All property owners have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for the protection of all people on a property whose presence is reasonably foreseeable. If a property owner has actual or constructive notice of a dangerous condition on a property, they must take action. Failing to take action could form the basis of a negligence claim. It is important that certain steps are taken after any apartment fire.

  • The cause of the fire should be determined.
  • Maintenance records on the apartment should be sought.
  • Medical records should be preserved.
  • An experienced attorney should be contacted.

Apartment fires are often highly preventable. Even if a fire does break out, certain safety features can help alert residents and thus prevent injury or death. But in far too many cases, apartments don’t have working smoke detectors. By the time many people realize that they are in danger, it is already too late. Any person injured in an apartment fire may have legal recourse through a civil claim.
