The motorcyclist was unable to avoid the collision and hit the side of the Jeep. He was thrown from his vehicle and seriously injured after hitting the roadway.

Paramedics were called to the scene of the crash to help the victim. He was transported to Stony Brook University Hospital to receive treatment.

Liability for Suffolk County Car Accidents

New York drivers are expected to operate their vehicles with the care necessary to avoid collisions. New York Vehicle and Traffic Law § 1163 Requires that any driver attempting to make a left or right turn must yield the right of way to oncoming vehicles and only initiate the turn when it can be made with reasonable safety. There are many factors to consider when evaluating liability for a car accident.

  • The speed of all vehicles involved should be taken into consideration.
  • The history of collisions at the intersection is also going to be considered.
  • It matters whether or not a driver was a bit distracted.
  • The distance between any vehicle approaching an intersection and a driver passing through is also consequential.

If a driver fails to slow down to avoid colliding with any people or property, this could be construed as negligence. Liability for a motorcycle collision could potentially extend to several parties. This includes the owner of a car if that person is separate from the driver of the vehicle. Victims of car accidents are able to seek some measure of accountability through a civil claim.
