Business owners in New York have a legal obligation to maintain their premises in a reasonably safe environment. This is codified under New York Labor Law § 200. According to the statute, “All places to which this chapter applies shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” There are a number of items to consider when assessing liability for any workplace accident.
When an employer fails to take reasonable precautions to prevent accidents involving heavy equipment, they could be held directly liable for any resulting injuries. It is important for victims to understand that they do have legal rights. They are able to seek some measure of accountability through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. A personal injury attorney can examine the unique facts of your case and let you know what your legal options are.
We at GLK Law extend our best wishes to the worker run over by this bulldozer at the Oneida County landfill. It is our hope that you’ll be able to make a full recovery. Any person that may have more information should reach out to OSHA. There needs to be a thorough review into all of the potential safety failures that contributed to what happened.
