Liability for Midtown, Manhattan Accidents

Buses are considered common carriers in New York. Their drivers are held to a heightened standard in terms of safety. Bus drivers must operate with an abundance of caution to avoid collisions. Pursuant to New York Vehicle Code 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” It is important that victims of bus accidents take certain measures to protect their rights.

  • Victims should seek medical treatment as soon as possible after any bus accident.
  • Victims should collect all of the contact information of eyewitnesses.
  • Victims should preserve as much evidence as possible related to the crash. This includes taking photos of the crash site.
  • Victims should seek the guidance of an experienced New York bus accident attorney.

If a bus driver fails to slow down to avoid a collision, this may be construed as negligence. Liability for the collision could extend beyond the driver deemed to be at fault. For example, the private employer or municipal agency that the bus driver worked for could also be responsible. As a general principle, employers in New York can be held vicariously liable for the wrongful actions of their workers–insofar as those workers were operating within the course and scope of their job duties.
