Liability for New York City Apartment Fires

Property owners in New York have a legal obligation to maintain their premises in a reasonably safe condition. Under New York Multiple Dwelling Law § 78, multiple dwelling units and their components must be periodically inspected and well maintained. Property owners are also required to abide by all fire and building codes. This necessitates that every apartment has unobstructed ingress and egress points that people can use to exit in the event of a fire. There could be multiple sources of liability for any apartment fire.

  • A property owner may not have installed working fire alarms.
  • A property owner may allow their electrical system to fall into disrepair.
  • A property owner may not have responded in time to a leak in a gas line.
  • A property owner may allow hallways or other clear access points to become cluttered.

When a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. Failing to take action to remedy a dangerous condition could form the basis of a negligence claim. Any person injured in a New York City residential fire may be able to seek some measure of accountability for a civil claim. This right extends to the surviving family member of any person who died in the collision.
