Liability for Long Island DUI Car Accidents

Every person operating a motor vehicle in New York must take reasonable precautions to avoid collisions with other drivers. This necessitates they abstain from alcohol and other potentially intoxicating substances. Pursuant to New York Vehicle and Traffic Law (VTL) § 1192, “No person shall operate a motor vehicle while the person’s ability to operate such motor vehicle is impaired by the consumption of alcohol.” There are multiple ways that alcohol can impair a person’s ability to operate their vehicle safely.

  • Alcohol can reduce the person’s ability to maintain a consistent speed.
  • Alcohol can impair a person’s ability to keep pace with the flow of traffic.
  • Alcohol can lower a person’s reaction time, which is critical for driving.
  • Alcohol can reduce a person’s muscle coordination.

If a driver fails to slow down to avoid colliding with a pedestrian in the roadway, they could be held liable through a civil claim. Drivers can also face criminal liability if they collide with a pedestrian while under the influence of alcohol or drugs. Victims of pedestrian accidents are protected by law. They are able to seek some measure of accountability through a civil claim. Damages in a civil claim can cover lost wages, medical bills, and pain and suffering.
