Liability For New York City Postal Truck Accidents

The number of e-bike and scooter accidents has continued to rise with the growth of companies like Lime and Bird. According to the Consumer Product Safety Commission, “There were more than 190,000 emergency room (ED) visits due to all micromobility products from 2017 through 2020. ED visits had a steady 70% increase from 34,000 (2017), 44,000 (2018), 54,800 (2019) to 57,800 (2020).” There are a number of common causes of e-bike accidents.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting bicyclists and pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a school bus driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of bicycle accidents tend to suffer very serious injuries, including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It can be hard to know where to begin after any car accident. To make matters worse, companies will often do everything in their power to deny liability if one of their drivers is involved in a fatal collision. The family of any person who is killed in a truck accident may have legal recourse through a bodily injury claim. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
