Investigation Underway After 5-Year-Old Boy Injured After Falling Three Stories From Window of Morrisania, Bronx Apartment

MORRISANIA, BRONX (April 8, 2026) – A five-year-old boy was seriously injured in Morrisania, Bronx after falling out of a third-floor window at an apartment by East 167th Street and Washington Avenue.

New York City officials are saying that the accident took place around 11 AM on Monday. Witnesses described hearing a thud after the child hit the ground.

Firefighters and paramedics were called to the scene of the accident to help the injured child. He was transported to a local area hospital to receive treatments.

It is currently suspected the child may have climbed out of the window that did not have any bars. A full investigation of the accident remains ongoing.

Liability for Bronx Window Fall Accidents

Apartment owners have a legal obligation to protect residence from reasonably foreseeable sources of harm. This includes preventing children from being harmed in window falls. According to the Department of Housing Preservation and Development, “In all buildings with three or more apartments, New York City (NYC) law requires that building owners install window guards if a child age 10 years or younger lives there, or if the tenant or occupant requests window guards for any reason.” Multiple actions should be taken after any window fall accident.

  • Victims should seek medical treatment as early as possible.
  • Maintenance records for the apartment unit involved should be collected.
  • Eyewitnesses should be interviewed while their memories are still fresh.
  • The parents of any injured child should contact an experienced personal injury lawyer.

If an apartment owner fails to take reasonable measures to prevent window accidents, this could serve as evidence of negligence. In particular, window bars can prevent the vast majority of these types of accidents. It is important for the victims of window accidents to understand that they do have legal options. They are able to seek some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
