Liability For Brooklyn Construction Accidents

Falls remain one of the leading causes of workplace injury and death in the construction industry. Scaffolds can be particularly hazardous. According to the United States Bureau of Labor Statistics (BLS), around 60 people are killed and another 4,500 people are injured every year in scaffold accidents. The vast majority of scaffold accidents are totally preventable. There are a number of other hazards that workers face at construction sites.

  • Workers have been electrocuted by open wires and machinery.
  • Workers may become pinned between vehicles or equipment.
  • Workers may become poisoned from noxious gases or dangerous chemicals.
  • Workers can become entrapped in trenches.

It is important that construction sites follow OSHA guidelines and local safety standards. Depending on the facts of any case, a company could be liable for an accident under New York Labor Law 241(6). This statute creates a non-delegable duty for owners and general contractors who employ workers in construction, demolition, and excavation. Owners and general contractors must “provide reasonable and adequate protection and safety to the persons employed therein or lawfully frequenting such places.” It is important that certain steps are taken after any construction accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • An experienced construction accident attorney should be contacted.

The vast majority of construction accidents are preventable and involve workplace safety violations. For example, workers may not be given fall protection when they are working at elevated heights. General contractors may fail to ensure that trenches are properly braced and reinforced. Any person that is injured in a construction accident may be able to seek some measure of justice through a civil claim.
