Liability for Staten Island Pedestrian Accidents

Pedestrians lack the protection of enclosed vehicles and are much more likely to be seriously injured in a crash. According to the IIHS, “A total of 7,314 pedestrian deaths occurred in 2023. Pedestrian fatalities account for 18% of all crash fatalities. Pedestrian deaths in 2023 have increased 78% since reaching their lowest point in 2009.” Drivers may have contributed to a crash in many different ways.

  • Drivers may have been traveling too fast for the prevailing conditions.
  • Drivers may be intoxicated by some substance.
  • Drivers may have failed to check their blind spots as they turned.

Every driver must exercise the care necessary to avoid colliding with any pedestrian. They must consciously scan the road ahead of them and slow down to avoid hazards. If a driver doesn’t slow down to avoid hitting a pedestrian, they could be held at fault for a crash. There could be several liable parties for any pedestrian accident.

  • A company could be liable for a collision if their driver was negligent and working within the course of their job duties.
  • The company that manufactured a vehicle could be liable if an accident was caused by a vehicle system failure.
  • A city or municipal entity responsible for a road could be liable for an accident caused by a dangerous condition on public property.

Pedestrian accidents tend to be avoidable. In fact, it has been estimated that 93% of all collisions involve some amount of human error. The family of any person killed in a car accident is able to seek some measure of justice through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
