Unmarked Police Van Involved in Fatal Brooklyn Pedestrian Collision Along Pennsylvania Avenue
BROOKLYN, NEW YORK (December 1, 2024) – A woman has tragically died in East New York, Brooklyn after being struck by an unmarked police van on Pennsylvania Avenue.
New York City officials are saying that the incident took place shortly after 6:00 p.m. on Wednesday. According to one witness, a woman may have been having some type of medical episode when she collapsed in the street.
It was shortly after this incident that she was hit by an unmarked police vehicle. Paramedics were called to the scene in order to help the victim.
She was taken to a local hospital where she was pronounced dead. A full investigation into the incident remains ongoing at this time.
Thousands of people are killed or seriously injured in pedestrian accidents every year. According to the Centers for Disease Control, “Over 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2022. That’s about one death every 64 minutes. There were also an estimated 140,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2022.” Several different factors could contribute to a pedestrian collision.

Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a truck driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a civil claim. It is important that certain steps are taken after any pedestrian accident.
Depending on the facts of any case, a police department could be liable for a pedestrian accident. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. When a police officer is not responding to an actual emergency with their lights and sirens on, they must obey traffic laws like every other driver.
