All drivers have a legal obligation to slow down to avoid collision with other vehicles. Pursuant to New York Vehicle Code 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” Speeding greatly increases the odds of collisions in many different ways.
The vast majority of car accidents are totally preventable. They tend to involve drivers that are distracted or committing some traffic infraction. In many situations, certain drivers may experience what is called “pedal confusion.” This occurs when a driver mistakes the accelerator for the brakes. Any person injured in a car accident may be able to seek some measure of justice through a bodily injury claim.
We at GLK Law extend our deepest condolences to the families of all of those killed in this Astoria food truck accident. Any person that may have more information about what happened should reach out to authorities. There needs to be a thorough investigation into what went wrong.
