Thousands of people are killed or seriously injured every year in car accidents across the United States. Many of the victims are pedestrians. According to the Centers for Disease Control, “Nearly 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2021. That’s about one death every 66 minutes. There were also an estimated 104,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2020.” There are a number of common causes of pedestrian accidents.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a truck driver fails to take evasive action to avoid hitting a pedestrian, this could form the basis of a negligence claim. Drivers who flee injury collisions could also face criminal liability. It is crucial that certain steps are taken after hit-and-run collisions.
Most pedestrian accidents are preventable and involve some amount of driver error. This is particularly true when collisions take place at night. Many drivers fail to slow down during periods of reduced visibility. It is important for accident victims to understand that they do have rights. The family of any person who died in a car accident may have legal recourse through a wrongful death claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman who died in this Jackson Heights collision. Any person who may have more information about what happened should reach out to the police. The driver involved in this collision should come forward.
