BROOKLYN, NEW YORK (July 24, 2024) – An elderly woman tragically died in a Brooklyn cement truck accident at the intersection of Utrecht Avenue and 49th Street.
New York City police officials are saying that the collision occurred around 11:55 a.m. on Tuesday. An elderly woman began crossing the street with a cane.
A semi-truck proceeded to drive through the intersection after the light turned green. The cement truck proceeded to run over the victim, causing them to sustain major injuries.
Firefighters and paramedics were called to the scene of the collision in order to help the woman. Despite life-saving measures, she was pronounced dead.
Commercial trucks pose a number of unique hazards for pedestrians, especially because they have large blind spots. According to the Federal Motor Carrier Safety Administration, “Never walk or ride too close to a large truck or bus. These vehicles have huge blind spots in the front, back, and on the sides, which make it difficult for the drivers to see pedestrians and bicyclists around them.” Truck drivers should take a number of measures in order to avoid hitting pedestrians.
All truck drivers have a legal obligation to take measures in order to prevent collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a truck driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Several factors could potentially contribute to any pedestrian collision.
Pedestrian collisions are often highly preventable. They tend to involve drivers who are simply not paying adequate attention to the road ahead of them. When commercial trucks are involved, accidents are much more likely to involve inexperienced drivers. The family of any person who died in a cement truck accident may be able to seek some measure of justice through a civil claim. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman who died in this Brooklyn cement truck accident. There needs to be a thorough investigation into what went wrong. Had the truck driver involved in this collision checked their blind spots, this tragedy may have been averted.
