QUEENS, NEW YORK (December 19, 2024) – A 36-year-old woman has tragically died in an Astoria, Queens car accident by 37th Street and 34th Avenue.
New York City officials are saying that the incident took place around 11:05 p.m. on Tuesday. A 36-year-old bicyclist was approaching the intersection when they were hit by a pickup truck.
The force of the impact caused the bicycle to be pulled underneath the vehicle. Paramedics were called to the scene in order to help the victim.
She was taken to Elmhurst Hospital in critical condition and later pronounced dead. A full investigation remains ongoing at this time.
Thousands of people are killed or seriously injured in bicycle accidents every year in the United States. According to the National Safety Council, “The number of preventable deaths from bicycle transportation incidents increased 10% in 2022 and have increased 47% in the last 10 years (from 925 in 2013 to 1,360 in 2022). At the same time, the number of preventable nonfatal injuries has declined 32%, from 493,884 in 2013 to 337,738 in 2022.” Drivers should take several measures in order to avoid hitting pedestrians.
All drivers have a legal obligation to take steps in order to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting a bicyclist, this could form the basis of a negligence claim. Several different factors may have contributed to a bicycle accident.
Bicycle accidents are often highly preventable. By their very nature, bicyclists have a small profile and are much easier to overlook. It is important to determine the circumstances surrounding any pedestrian accident. The family of any person who died in a pedestrian accident may have legal recourse through a civil claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman who died in this crash. Any person who may have more information about what happened should reach out to the police. It is our sincere hope that measures will be taken to make this intersection safer.
