Every employer in the United States has a legal obligation to maintain a safe working environment for their employees. According to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Employers should take a number of actions to prevent industrial accidents.
In certain situations, employers can be directly liable for workplace accidents. According to New York Labor Law § 200, worksites must be maintained in a reasonably safe condition. To that end, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” Any person injured in an industrial accident may be able to pursue damages through a civil claim.
We at GLK Law extend our best wishes to the worker injured in this East Farmingdale pedestrian accident. Any person who may have more information about what happened should reach out to OSHA. There needs to be a thorough investigation into what went wrong.
