Liability For Town of Gouverneur Semi-Truck Accidents

There are many factors that could contribute to car accidents. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are a number of measures that semi-truck drivers should take in order to avoid collisions.

  • Semi-truck drivers should be well rested before the start of their shift.
  • Semi-truck drivers should abstain from alcohol and other intoxicating substances.
  • Semi-truck drivers should have their vehicles periodically inspected and well maintained.

All truck drivers have a legal obligation to exercise due care in order to avoid collisions. There is a rebuttable presumption of negligence on the part of any driver that leaves their designated lane of travel and hits another vehicle head-on. Any person that is injured in a car accident may have legal recourse through a bodily injury claim. It is important that evidence is properly preserved after any truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • The truck driver’s logbook should be reviewed.

It can be hard to know what to do after any truck accident. To make matters worse, truck companies will often do everything that they can in order to avoid liability for any collision. This is why it is so important that evidence is properly preserved. The family of any person that died in a semi-truck accident may have legal recourse through a civil claim.
